歐盟各國RoHS及WEEE罰則說明 (四)

最後,繼續簡介歐盟成員國包括:捷克、馬爾他、立陶宛、拉脫維亞、斯洛伐克、斯洛維尼亞及英國等七個國家關於《電子及電器設備廢棄物處理法》(WEEE)及《限用六大有害物質指令》(RoHS)的罰則,請參考以下說明。

◎ 捷克
● 違反捷克的RoHS及WEEE法例。
※ 未能履行第185/2001 Coll號法令下產品廢料管理責任的生產商。
罰款多達CZK(捷克克朗) 1,000萬。
※ 違反其他規定。
最罰款多達CZK 100萬。違規情況嚴重者,罰款金額亦較高。

◎ 馬爾他
● 違反RoHS---根據《產品安全法》。
違規情況嚴重者,罰款金額亦較高。
※ 提供虛假資料者。
可被罰款逾MTL(馬爾他磅) 200,但不超過MTL 1,000,及入獄最多6個月。
※ 初犯者。

RoHS and WEEE Penalties for EU Member States (4)

The current implementation status and penalties of Directive 2002/96/EC on waste electrical and electronic equipment (WEEE) and Directive 2002/95/EC on the restriction of the use of certain hazardous substances in electrical and electronic equipment (RoHS) will be of interest to businesses importing electronic goods into the EU. We are continuing to provide reports in this and forthcoming issues on eventually all 25 Member States. The following text provides an update of the current situation with penalties in Czech Republic, Malta, Lithuania, Latvia, Slovakia, Slovenia and UK:

◎ CZECH REPUBLIC:

RoHS - The general provisions on penalties in the general waste management law of the Czech Republic (Act 185/2001 Coll.) provide that failure to fulfil the duties relating to the management of selected products or wastes or equipment pursuant to Part Four (which includes the provisions on WEEE and RoHS) can attract a fine of up to 10,000,000 Czech Crowns. Breach of other duties stipulated by Act 185/2001 Coll. can attract a fine of up to 1,000,000 Czech Crowns. Higher fines may be invoked where the breach of the relevant provisions is deemed sufficiently serious or in light of aggravating circumstances.

◎ MALTA:

RoHS - Under the Product Safety Act:
• For false information/obstruction- fine of more than Lm200 and not exceeding Lm1,000 and/or up to 6 months imprisonment.
• 1st conviction- fine of more than Lm500 and not exceeding Lm5,000 and/ or up to 3 years imprisonment.
• 2nd or subsequent offence- fine of more than Lm750 and not exceeding Lm10,000 and/or up to 4 years imprisonment.
• Court has additional powers to suspend or cancel licence or licences
Higher fines may be invoked where the breach of the relevant provisions is deemed sufficiently serious or in light of aggravating circumstances.
WEEE - Under Environmental Protection Act: A person who commits an offence against the Regulations will be liable, on conviction, to a fine of between Lm500 and Lm1,000. Subsequent offences will lead to a fine of between Lm1,000 and Lm2,000. Offenders can be sentenced to a term of imprisonment of up to two years in addition to or instead of the fine. Higher fines may be invoked where the breach of the relevant provisions is deemed sufficiently serious or in light of aggravating circumstances.

◎ LITHUANIA:

RoHS - The Ministry officials are themselves unclear as regards the applicable penalties for non-compliance with the RoHS regulations.
WEEE -The draft Amendment to the Administrative Code is currently before Parliament and changes are expected. For information purposes, the anticipated penalties include (fines shown in euros):
• Failure to comply with marking requirements, requirements to inform user or waste treatment facilities - fine of EUR300- EUR600;
• Failure to register at Register of producers, rules for retailers to sell appliances of only registered producers- fine of EUR300- EUR600;
• Failure to comply with mandatory take-back rule (1:1) - fine of EUR300-EUR900
• Failure to provide treatment for WEEE- fine of EUR300 - EUR29,000;
• Failure to comply with reporting requirements- (reporting on time) - fine of EUR58 - EUR300.

◎ LATVIA:

RoHS - There are currently no set penalties for non-compliance with the Latvian RoHS regulations. The Ministry of Environment is preparing amendments to the Administrative Code, and these provisions are expected to be in place by 01/07/2006.
WEEE -Non-compliance by legal persons with the provisions of the Latvian WEEE regulations is subject to the following fines:
• Failure to register as a producer - 150 - 300 lats (approximately EUR215 - EUR430);
• Failure to use correct marking on products - 100 - 250 lats (approximately EUR145 - EUR360);
• Failure to report on management of WEEE - 250 - 500 lats (approximately EUR360 - EUR720).
Higher fines may be invoked where the breach of the relevant provisions is deemed sufficiently serious or in light of aggravating circumstances.

◎ SLOVAKIA:

RoHS - Slovak legislation provides for maximum penalties of 5,000,000 Slovak crowns. Higher fines may be invoked where the breach of the relevant provisions is deemed sufficiently serious or in light of aggravating circumstances.
WEEE - Penalties are scaled depending on the type of infringement. The maximum applicable penalties can reach 5,000,000 Slovak crowns. Higher fines may be invoked where the breach of the relevant provisions is deemed sufficiently serious or in light of aggravating circumstances.

◎ SLOVENIA:

RoHS - Penalties are set in the Chemicals Act of 12/11/2003 in art. 66 (fines range from approximately EUR2,000- EUR83,000).
WEEE - control of the producers' duties performed by environmental inspectors from the Inspectorate for Environmental Protection. Ban from market possible.
New legislation has been introduced in Slovenia to penalise producers who failed to register. This legislation was introduced via the Decree on the Tax for environmental pollution arising from WEEE published in Official Journal of RS No. 32/2006 ( 28/3/2006 ) ref. no.1314. Producer penalties for failing to register with customs and to report quantities of EEE put on the market range from 1 to 10 million SIT (approximately EUR4170 - to EUR41,700).




◎ UK:

RoHS -
• summary conviction- a fine of up to EUR5,000;
• conviction on indictment- an unlimited fine;
• failure to submit compliance documentation on request and within 28 days- a fine of up to EUR5,000;
• Non-compliant products can be taken off the market and where offence is committed with the consent, connivance or through neglect of any director, manager or similar officer of the corporate body, they will also be regarded as having committed the offence.
Higher fines may be invoked where the breach of the relevant provisions is deemed sufficiently serious or in light of aggravating circumstances.
WEEE -Although not yet confirmed, the fine could be up to EUR5,000 for lesser breaches with an unspecified fine being applicable to more serious breaches.
